General

NOTE: Please read these Terms of Use before using the application. Installation of the application means that you agree with the terms of these Terms of Use without any limitations. If you disagree with these Terms of Use, cancel the mobile application installation and do not use its software.

Introduction

Welcome to MIEA Health — an application allowing to communicate through WhatsApp API. Before using  MIEA Health, please read the following Terms of Use (hereinafter — “Terms”). The Terms below govern your use of MIEA Health. By using MIEA Health, you accept these Terms and agree to be bound by the Terms. These Terms form a legally binding agreement between you and the Application Provider in relation to your use of MIEA Health. If you do not agree to these Terms, please do not use MIEA Health. Application Provider reserves the right, at its sole discretion, to change, modify, add or remove a portion of the Terms at any time.

You agree that using MIEA Health does not replace proper child, pet, or person under your guardianship care.

You agree that you are solely responsible for (and that Application Provider has no responsibility to you or any third party for) any breach of your obligations under the Terms and for the consequences (including any loss or damage which Application Provider may suffer) of any such breach. You agree that you are using the app in accordance with any laws applicable in your country.

No warranty

You expressly acknowledge and agree that the use of MIEA Health is at your sole risk and the entire risk as to the satisfactory quality, performance, accuracy, and effort are with you. To the maximum extent permitted by applicable law, MIEA Health and any services performed or provided by the Application Provider (“Services”) are provided “as is” and “as available”, with all faults and without warranty of any kind, and Application Provider hereby disclaims all warranties and conditions with respect to MIEA Health and any Services, either express, implied or statutory. Application Provider does not warrant against interference with your enjoyment of MIEA Health, that the functions contained in, or Services performed or provided by, MIEA Health will meet your requirements, that the operation of MIEA Health or Services will be uninterrupted or error-free, or that defects in MIEA Health or Services will be corrected. No oral or written information or advice given by the Application Provider or its authorized representative shall create a warranty. Should MIEA Health or Services prove defective, you assume the entire cost of all necessary servicing, repair, or correction.

Limitation of Liability

To the extent not prohibited by law, in no event shall Application Provider be liable for personal injury or any incidental, special, indirect, or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption or any other commercial damages or losses, arising out of or related to your use or inability to use MIEA Health, however, caused, regardless of the theory of liability (contract, tort or otherwise) and even if Application Provider has been advised of the possibility of such damages.

Changes in the Services

Application Provider may, but is not obligated to, maintain the Services with periodic releases of bug fixes, code updates, or upgrades. Application Provider will determine, at sole discretion, the frequency and scope of such releases. You will have no plea, claim or demand against the Application Provider for any of these releases or the lack thereof. You agree that Application Provider will not assume any responsibility concerning or in connection with introducing such changes or any malfunctions or failures that may result.
